Mensagem dos Co-Presidentes do International Bar Association’s  Human Rights Institute, por ocasião do lançamento do 7° Prêmio Innovare

É com grande orgulho e expectativa que aguardamos por esta nova e emocionante iniciativa conjunta entre o Instituto Innovare e International Bar Association's Human Rights Institute. E com pesar que informamos que não poderemos participar da cerimônia de lançamento do 7° Prêmio Innovare e por favor, aceitem nossas desculpas - Esperamos ter a oportunidade de visitar seu belo país novamente, em breve. 

Como muitos de vocês já sabem, o IBAHRI trabalha para proteger a independência da profissão de advogado e promover os direitos humanos e o Estado de Direito. O IBAHRI é ativo em todo o mundo. 

Nos últimos dois anos, ajudamos a estabelecer uma associação de nacional de advogados no Afeganistão, conduzimos missões para o Quênia e para Rússia, treinamos advogados malaios, iraquianos e moçambicanos, em direitos humanos, para citar apenas alguns exemplos. 

Na América Latina, já trabalhamos em vários países, incluindo Colômbia, Venezuela e Bolívia, no entanto, só recentemente começamos a trabalhar no Brasil. 

O primeiro relatório da IBAHRI sobre o Brasil, intitulado “Um em cada cinco: a crise nas prisões do Brasil e do sistema de justiça penal”, lançado no mês passado em São Paulo, analisou muitos dos complexos desafios da justiça penal e política penal no Brasil. Ele destacou algumas estatísticas alarmantes sobre o alcance destes desafios. Por exemplo, segundo o mutirão do Conselho Nacional de Justiça, entre os casos analisados, até agora, uma em cada cinco pessoas estão sendo mantidas irregularmente em prisão preventiva. 80% dos presos não pode sequer pagar um advogado. 

É claro que a justiça deve ser mais próxima do povo do brasileiro. Uma estratégia de reforma eficaz deve lidar com a questão da reforma abrangente da justiça penal. O problema relativo ao acesso à justiça na prisão preventiva não pode ser tratado isoladamente do contexto da crise do sistema de justiça brasileiro e da criminalidade na sociedade. Como refletido pelo tema principal do prêmio Innovare deste ano, com foco em uma área específica, através da criação de novas entidades, que poderiam tornar a situação ainda pior, aumentando a burocracia para um sistema já disfuncional. Mais esforços precisam ser feitos para assegurar as peças existentes para que o sistema funcione melhor incentivando o desenvolvimento. 

Estamos muito entusiasmados por ver que existem muitos grupos que mostram a criatividade, pela qual os brasileiros são tão famosos, na tentativa de elaborar respostas à atual crise no seu sistema de justiça criminal encontrando maneiras de contornar os vários obstáculos existentes. 

O trabalho desses grupos reflete um reconhecimento generalizado de que a suposta dicotomia entre a necessidade de maior segurança e respeito pelos direitos humanos é um falso. Uma justiça penal e sistema penal que respeitem os direitos humanos e o Estado de Direito, provavelmente serão mais eficazes do que tolerar o atual status quo. Embora isso exija um maior investimento, os seus benefícios para a sociedade, como um todo, superam esses custos.

Por essa razão o trabalho do Instituto Innovare é tão importante e por isso, através do incentivo a estes grupos de trabalho para melhorar o acesso à justiça, o instituto é verdadeiramente líder em seu campo. É também por isso que o IBAHRI tem a honra de co-patrocinar um prêmio especial com Innovare deste ano centrado no acesso à representação legal em prisão preventiva - uma área que afeta os direitos humanos fundamentais não apenas os acusados de delitos, mas as aspirações de todos os brasileiros de viver em uma sociedade verdadeiramente democrática e justa. 


Desejamos-lhe as maiores felicidades e estamos confiantes que este ano será muito bem sucedido para o Innovare.

Message from the International Bar Association Human Rights Institute Co-Chairs to the Innovare Institute on the occasion of the inauguration of the 7^th Innovare prize

Distinguished Guests, Ladies and Gentlemen

It is with great pride and anticipation that we look forward to this exciting new joint initiative between the Innovare Institute and the International Bar Association’s Human Rights Institute. It is with regret that we are not able to attend the inauguration ceremony of the 7^th Innovare Prize and please accept our apologies - we hope to have the opportunity to visit your beautiful country again soon.

As many of you will already know, the IBAHRI works to protect the independence of the legal profession and to promote human rights and the rule of law. It is active all over the world.

For example, in the past couple of years, it has helped to establish a national bar association in Afghanistan, conducted fact-finding missions to Kenya and Russia and trained Malaysian, Iraqi and Mozambican lawyers in human rights to name but a few examples.

In Latin America it has worked in several countries, including Colombia, Venezuela and Bolivia, however it is only recently that we have begun to work in Brazil.

The IBAHRI’s first report on Brazil, ‘One in Five: the Crisis in Brazil’s prisons and criminal justice system’ was launched last month in Sao Paulo and examined many of the complex challenges facing criminal justice and penal policy in Brazil. It highlighted some alarming statistics regarding the extent of these challenges. For example, according to the National Justice Council mutirão scheme, out of the cases it has reviewed so far, one in five pre-trial detainees are being held irregularly. 80% of prisoners cannot even afford a lawyer.

It is clear that justice must be brought closer to the people of Brazil. An effective reform strategy must deal with the issue of criminal justice reform comprehensively. The problem regarding access to justice in pre-trial detention cannot be treated in isolation from the context of the crisis in the Brazilian justice system and the wider problem of tackling crime in society. As is reflected by the main theme of the Innovare prize this year, focusing on fixing one particular area, through the creation of new institutions could make the situation worse by adding fresh layers and bureaucracy to an already dysfunctional system. More effort needs to be made to ensure the existing parts of the system work better and by encouraging home-grown, incremental reform.

We are extremely encouraged to see that there are many groups showing the creative ingenuity for which Brazilians are so famous in attempting to develop responses to the current crisis within their criminal justice system through finding a way around the various obstacles that exist. 

The work of these groups reflects a widespread recognition that the supposed dichotomy between the need for greater security and respect for human rights is a false one.  A criminal justice and penal system which respects human rights and the rule of law is likely to be a more effective one than tolerating the current status quo.  Although this will require greater investment, its benefits to society as a whole far outweigh these costs.

This is where the work of the Innovare Institute is so important and why through its encouragement of these groups working to improve access to justice, it is truly a leader in its field. It is also why the IBAHRI is honoured to co-sponsor a special prize with Innovare this year focussing on access to legal representation in pre-trial detention - an area that affects the fundamental human rights not just those accused of criminal offences, but the aspirations of all Brazilians to live in a truly democratic and fair society.

We wish you all the very best of luck and are confident that this year will be the most successful yet for Innovare.
